1. Who may use the Site
The Site is intended for business and commercial use by roofing contractors, general contractors, builders, and other trade professionals. It is not directed to consumers making personal, family, or household purchases, and it is not directed to individuals under 18 years of age. By using the Site you represent that you are at least 18 years old and that, if you are acting on behalf of a company, you have authority to bind that company to these Terms.
2. No offer to sell
All content on the Site — including product descriptions, specifications, colors, availability indicators, and lead times — is provided for general informational purposes only. Nothing on the Site is a binding offer to sell, a quote, or a price commitment, and nothing on it creates a contract.
3. Product information, specifications, and color
Accuracy
We make reasonable efforts to describe our materials accurately, including gauge, substrate, profile, coating system, and dimensions. However, we do not warrant that product descriptions, specifications, availability indicators, lead times, or other Site content are accurate, complete, current, or error-free. Specifications are subject to change without notice, including as a result of changes by our mills, coil suppliers, or coating manufacturers.
Color representation
Colors shown on the Site, including in any interactive color selector, are digital representations and will vary from the actual coated product depending on your screen, lighting, viewing angle, and finish. Digital color is not suitable for final color approval. You must obtain and approve an actual metal sample of the specific color and coating before placing an order. We are not responsible for color variation between what is displayed on the Site and the product delivered, or for variation between production runs or coil lots.
Stock status
Any indication that a color, profile, or item is “in stock” reflects our records at the time the page was generated and is not a guarantee of availability. Availability is confirmed only in a written quote or order acknowledgment.
4. Quote and sample requests
Requests submitted through the Site, including quote requests and color sample requests, are inquiries only. They are not orders, they do not obligate us to sell or to supply, and they do not create any contract. We may decline any request for any lawful reason.
A binding arrangement arises only when we issue a written quote that you accept, or a written order acknowledgment, on the terms stated in those documents.
“Sales Documents” means our written quotes, order acknowledgments, invoices, credit applications, and any terms and conditions of sale provided with them. The Sales Documents, not these Terms, govern the sale of materials, including pricing, payment, delivery, returns, and any warranty we provide.
5. Code approvals and installation
Any reference on the Site to a Miami-Dade County Notice of Acceptance (NOA), a Florida Product Approval, or any other code approval refers to the specific assembly, configuration, and installation method described in that approval document. An approval applies only when the product is installed exactly as specified, with the specified components, fasteners, spacing, and substrate.
We supply materials. We do not perform design, engineering, or installation, and we are not the engineer or design professional of record. You are solely responsible for:
selecting products appropriate for the project, exposure, and wind zone;
verifying that the assembly satisfies the Florida Building Code and all applicable local requirements, including high-velocity hurricane zone requirements where they apply;
obtaining all permits and approvals;
proper installation in accordance with the manufacturer's instructions and the applicable approval; and field verification of all dimensions and quantities.
Approval documents are current as of the date posted and may be revised, renewed, or revoked by the issuing authority. Confirm the current status of any approval with the issuing authority before relying on it.
6. Disclaimer
The site and all content on it are provided “as is” and “as available.” To the fullest extent permitted by law, Southern Coast Metals disclaims all warranties of any kind with respect to the site and its content, whether express, implied, statutory, or otherwise, including without limitation any implied warranty of merchantability, any implied warranty of fitness for a particular purpose, any warranty of accuracy or completeness, and any warranty of title or non-infringement. Southern Coast Metals does not warrant that the site will be uninterrupted, secure, or error-free, or that any defect will be corrected.
This section concerns the Site and its content. Any warranty applicable to materials we sell is addressed in the Sales Documents and in any warranty offered directly by the coil, coating, or component manufacturer. Manufacturer warranties are provided by the manufacturer, not by us, and are subject to the manufacturer's own terms, registration requirements, and exclusions.
Some jurisdictions do not allow the exclusion of certain implied warranties, so portions of this exclusion may not apply to you.
7. Limitation of liability
To the fullest extent permitted by law, in no event shall Southern Coast Metals or its officers, directors, members, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost business, loss of use, cost of substitute goods, labor costs, delay damages, or amounts you owe to a third party, arising out of or relating to the site or these terms, regardless of the theory of liability and even if Southern Coast Metals has been advised of the possibility of such damages.
To the fullest extent permitted by law, the total aggregate liability of Southern Coast Metals arising out of or relating to the site or these terms shall not exceed one hundred dollars ($100).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, for willful misconduct, or for personal injury or death caused by our negligence. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
8. Calls, texts, and email
By submitting a form on the Site, you consent to receive communications from us electronically, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
Telephone and text messages. If you provide a telephone number and check the consent box on our form, you give your express written consent to receive telephone calls and text messages from Southern Coast Metals and those acting on our behalf at that number, regarding your inquiry, quote, order, or our products and services — including calls and messages made using an automatic telephone dialing system or an artificial or prerecorded voice.
Consent is not a condition of purchase or of receiving a quote; you may request a quote by calling or emailing us instead. Message and data rates may apply. Message frequency varies.
How to stop. Reply STOP to any text message to opt out of texts, or contact us using the details in Section 15. Reply HELP for help. You may opt out of marketing email using the unsubscribe link in any message. After you opt out of marketing, we may still contact you about an active quote or order.
9. Intellectual property
The Site and its contents — including text, graphics, photographs, product imagery, logos, trade dress, page layout, and software — are owned by Southern Coast Metals or its licensors and are protected by United States copyright, trademark, and other laws. “Southern Coast Metals” and the SCM logo are our trademarks. Third-party marks appearing on the Site, including those of coating and material manufacturers, belong to their respective owners and are used for identification only; their appearance does not imply endorsement.
You may view, download, and print Site content solely for your internal business use in connection with specifying or purchasing our materials. You may not otherwise reproduce, distribute, publicly display, modify, create derivative works from, or commercially exploit Site content without our prior written consent.
10. What you send us
If you send us sketches, drawings, dimensions, photographs, or specifications in connection with a quote (“Submissions”), you represent that you have the right to do so and that they do not infringe any third party's rights. You grant us a non-exclusive, royalty-free license to use the Submissions solely to prepare a quote, fabricate and fulfill any resulting order, and maintain our internal records.
We will not publish a Submission that identifies a specific customer or project in our marketing without your permission. Please do not send us confidential information you do not want used for these purposes.
11. Acceptable use and third-party links
You agree not to use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site or related systems; scrape, harvest, or systematically extract data from it; introduce malicious code; interfere with its operation; or misrepresent your identity or affiliation.
The Site may link to third-party sites, including manufacturers, carriers, and code authorities. We do not control and are not responsible for their content, products, services, or privacy practices. Links do not imply endorsement.
12. Indemnification
You agree to indemnify, defend, and hold harmless Southern Coast Metals and its officers, directors, members, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your breach of these Terms, the content of your Submissions, or your violation of any law or third-party right.
13. Governing law and venue
These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Florida, without regard to its conflict of laws principles.
The exclusive venue for any action shall be the state or federal courts located in Miami-Dade County, Florida. Each party consents to the personal jurisdiction of those courts, waives any objection based on venue or forum non conveniens, and waives any right to a trial by jury. The prevailing party in any action to enforce these Terms is entitled to recover its reasonable attorneys' fees and costs.
14. General provisions
Changes. We may revise these Terms at any time by posting an updated version with a new effective date. Changes apply to use of the Site after that date. Your continued use constitutes acceptance.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site, and supersede prior understandings on that subject. They do not govern the sale of materials, which is addressed in the Sales Documents.
Severability. If any provision is held unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or severed if that is not possible. The rest remains in force.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our prior written consent. We may assign freely, including in connection with a merger or sale of assets.
No third-party beneficiaries. These Terms create no rights in anyone who is not a party.
Survival. Sections 6, 7, 9, 10, 12, 13, and 14 survive.
